This document sets out the terms and conditions governing your use of The Premium Way website and services.

This website is operated by The Premium Way. Throughout this document, the terms "we", "us" and "our" refer to The Premium Way. We offer this website, including all information, tools, products and services available from this site, to you (the "user") conditioned upon your acceptance of all terms, conditions, policies and notices stated herein.
By visiting our site and/or purchasing products from us, you engage in our "Service" and agree to be bound by these Terms of Service, including any additional terms, conditions and policies referenced herein or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation browsers, customers, merchants and contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you must not access the website or use any services.
2. ELIGIBILITY AND ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that:
• You are at least 18 years of age, or the age of majority in your state or territory of residence (whichever is higher).
• If you are the age of majority, you have given us your consent to allow any of your minor dependents to use this site under your supervision.
• You will not use our products for any unlawful or unauthorised purpose.
• Your use of the Service will not violate any applicable laws or regulations, including but not limited to Australian Commonwealth, state and territory laws.

3. GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including payment card information) may be transferred unencrypted and involve:
• Transmissions over various networks.
• Changes to conform and adapt to technical requirements of connecting networks or devices.
Payment card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from us.
4. PRODUCTS AND SERVICES
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to our Returns and Refunds Policy.
We reserve the right, but are not obligated, to limit the sale of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion.
Important: The Premium Way does not sell tobacco, molasses, nicotine, or any products that contain nicotine. Our product offerings strictly exclude these substances. Any reference to product categories or accessories on our site should be understood in this context.
We do not warrant that the quality of any products, services, information or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
5. PRICING, BILLING AND ACCOUNT INFORMATION
5.1 Accuracy of Information
We strive to ensure all pricing and product information displayed on the site is accurate and current. However, errors may occur. If a product is listed at an incorrect price or with incorrect information, we reserve the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed and your payment card has been charged. If your payment card has already been charged and your order is cancelled, we will issue a refund to your original method of payment.
5.2 Order Acceptance
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same payment card, and/or orders that use the same billing and/or shipping address. In the event that we change or cancel an order, we will attempt to notify you by contacting the email and/or billing address or phone number provided at the time the order was placed.
5.3 Overselling
We use Shopify for inventory management and payment processing. There is a known limitation where a product may be oversold, particularly during high-demand periods when many customers are attempting to order the same product or product variant simultaneously. If this occurs, we will contact you promptly to arrange an alternative resolution, which may include a full refund, a backorder or a product substitution with your consent.
6. PRICE MATCHING POLICY
We will match the price of an identical stocked product from an eligible competitor, subject to the following conditions:
• Price matching applies only to Australian online retailers. Physical or brick-and-mortar store prices are not eligible.
• The identical item and variant must be currently in stock with the competitor at the time of your request.
• You must provide a direct link to the competitor's product listing.
• This policy does not extend to products that contain tobacco, molasses, or nicotine, as The Premium Way does not sell these items.
• Price matching does not apply to clearance, liquidation, flash sales or marketplace listings from individual third-party sellers.
• We reserve the right to verify competitor pricing and may decline a price match request at our sole discretion.
7. SUBSCRIBE AND SAVE
By selecting the "Subscribe & Save" option on a product page, you agree to the following:
• You will receive recurring email reminders regarding upcoming payments in advance of each renewal.
• You may cancel or modify your subscription at any time by contacting us at support@thepremiumway.com.au or through your account dashboard.
• Subscription pricing is subject to change; any price changes will be communicated to you in advance.
• We are not responsible for orders placed under a subscription if your payment card details are no longer valid or have changed.
8. SHIPPING AND DELIVERY
Please refer to our dedicated Shipping Policy page for full details on shipping methods, estimated transit times and delivery charges. Key points include:
• Shipping times are estimates only and are not guaranteed. Delays caused by courier services, customs, weather, or other events outside our control are not our responsibility.
• Risk of loss and title for items purchased from us pass to you upon delivery to the carrier.
• It is your responsibility to ensure your shipping address is accurate. We are not liable for orders shipped to incorrect addresses provided by the customer.
9. RETURNS AND REFUNDS
Please refer to our dedicated Returns and Refunds Policy for full details. Where not covered by that policy, the following general principles apply:
• Products must be returned in their original, unused condition and packaging.
• Certain products may be exempt from return due to hygiene or health and safety reasons.
• We comply with Australian Consumer Law. Nothing in these Terms of Service limits or excludes any consumer guarantees or rights you may have under the Australian Consumer Law.
10. WARRANTY POLICY
10.1 Scope and Duration
We do not provide warranties on any of our products, with the exception of electric burners. Electric burners carry a warranty valid for fourteen (14) days from the date of delivery.
10.2 Claim Initiation
If you encounter an issue with a product, you must contact us within twenty-four (24) hours of delivery to initiate a warranty claim. Please email us at support@thepremiumway.com.au and provide:
• A detailed description of the issue.
• Supporting documentation, photos or videos demonstrating the problem.
• Your order number and delivery confirmation details.
10.3 Claims After 24 Hours
Claims made after the 24-hour window from delivery will not be processed under warranty. It is essential that any issues are reported promptly within this period.
10.4 Post-Warranty Support
If a problem arises after the 24-hour claim window, we are unable to provide replacements, refunds, exchanges or store credits. However, we are committed to offering troubleshooting support and guidance where possible. Please contact us and we will do our best to assist.
10.5 Manufacturer Support
In addition to our support, you may contact the product manufacturer directly via their website or social media channels. They may be able to offer additional assistance or troubleshooting advice.
10.6 Imported Products
Our products are 100% imported. As such, any international warranty provided by manufacturers is not valid on products purchased through The Premium Way.
10.7 Australian Consumer Law
Nothing in this warranty policy excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by Australian Consumer Law that cannot lawfully be excluded or limited.
11. THIRD-PARTY TOOLS AND LINKS
We may provide you with access to third-party tools over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools on an "as-is" and "as-available" basis without any warranties, representations or conditions of any kind.
Certain content, products and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of such materials, and we do not warrant and will not have any liability or responsibility for any third-party materials, websites, or for any other materials, products or services of third parties.
12. USER COMMENTS, FEEDBACK AND SUBMISSIONS
If, at our request or without a request, you send certain specific submissions (for example, contest entries, product reviews, suggestions, or creative ideas), or you send us any feedback, comments, or other content, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any such content that you forward to us.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party's intellectual property or these Terms of Service.
You agree that your comments and submissions will not violate any rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights. You further agree that your content will not contain defamatory, libellous, offensive, or otherwise unlawful material.
13. PERSONAL INFORMATION AND PRIVACY
Your submission of personal information through our store is governed by our Privacy Policy. We encourage you to review our Privacy Policy, available on our website, to understand how we collect, use and protect your personal information.
14. PROHIBITED USES
In addition to other prohibitions as set forth in these Terms of Service, you are prohibited from using the site or its content:
• For any unlawful purpose.
• To solicit others to perform or participate in any unlawful acts.
• To violate any international, Commonwealth, state or territory regulations, rules, laws or local ordinances.
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability.
• To submit false or misleading information.
• To upload or transmit viruses or any other type of malicious code.
• To collect or track the personal information of others.
• To spam, phish, pharm, pretext, spider, crawl or scrape.
• For any obscene or immoral purpose.
• To interfere with or circumvent the security features of the Service.
We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
15. TEXT AND SMS/MMS MARKETING
15.1 Consent
By subscribing to The Premium Way text notifications, you agree to receive automated marketing text messages from us about our products and services at the phone number you provided when you subscribed. Messages may be sent via an automatic telephone dialling system or other technology.
15.2 Opt-Out
Consent is not a condition of any purchase. You may opt out of receiving text messages at any time by replying STOP to any message or by contacting us at support@thepremiumway.com.au. Message and data rates may apply.
15.3 Program Terms
By opting in to or participating in any of our messaging programs, you accept and agree to these terms and conditions, including your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the Dispute Resolution section below.
16. ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice.
17. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you. You expressly agree that your use of, or inability to use, the Service is at your sole risk.
In no case shall The Premium Way, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including but not limited to lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service.
Australian Consumer Law: Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.
18. INDEMNIFICATION
You agree to indemnify, defend and hold harmless The Premium Way and our parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
19. SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
20. TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.
21. ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect of the Service constitute the entire agreement and understanding between you and us, and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us.
22. DISPUTE RESOLUTION
Any disputes arising out of or relating to these Terms of Service shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally within thirty (30) days, either party may refer the matter to mediation.
If mediation is unsuccessful, the dispute shall be submitted to binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA) or such other arbitration body as may be agreed by the parties.
The arbitration shall take place in Melbourne, Victoria, Australia, and shall be conducted in English. The decision of the arbitrator shall be final and binding on both parties.
Nothing in this clause limits your rights under the Australian Consumer Law to bring a claim before a relevant tribunal or court.
23. GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, and the applicable laws of the Commonwealth of Australia. You and The Premium Way both submit to the non-exclusive jurisdiction of the courts of Victoria.
24. CHANGES TO TERMS OF SERVICE
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
